Whiplash can occur in almost every accident involving a collision. Unfortunately the symptoms can be deceptive with the pain manifesting itself some time after the accident.

The best advice is to report the collision as soon as you can to a lawyer who specialises in the type of injury arising from whiplash. Generally the fact of reporting is in the form of a first consult and is invariable free.

What you are really dealing with is the Insurance Company with whom you have you accident policy. Most Insurance Companies are professional and will investigate the claim of whiplash injury objectively. But some wont, and will go to great lengths to avoid payment of the claim. Thus the sooner you report your injury to your lawyer, the less likely it is that the Insurance Company will
be in a position to deny your claim.

Irrespective, always have in mind that you may be subject to a claim from the other party and your report to your lawyer will at least deflect the approach so that it becomes your case and not theirs.

Despite the hype, do not rely on Air Bags to prevent whiplash. Every accident is different and air bags may or may not be provide suitable protection from the resulting collision.

How much is the pain and discomfort of your whiplash injury worth?

A fair question, after all a whiplash injury is painful; so you should be compensated accordingly. Unfortunately, however, the level of compensation you get for your injury following an accident will depend on a number of variable factors.

The whiplash compensation claim

The first of the variable factors will depend on how you make your whiplash injury claim. If you make a compensation claim directly against the insurance company, then you will likely be compensated in accordance with the settlement agreement you make with the insurance company.

However, if you decide to seek the advice of a compensation solicitor to handle your whiplash compensation, then you could be entitled to compensation categorised as (i) general damages and (2) special damages.

General damages for whiplash

The overall amount that you may be entitled to under General Damages is difficult to determine as it is paid for the physical pain and suffering (i.e. the actual damage, such as a whiplash neck injury or something more serious) that you encounter as a direct result of the accident you had. You may also be allowed to claim for emotional pain and loss of enjoyment of life as part of General Damages. Finally, if the pain and suffering you encounter as a result of your injury causes you to suffer psychological disorders, such as depression, then this may also be included in your compensation claim.

Although General Damage sums awarded by a court will be dependant on their set guidlelines, the details of your medical report detailing the extent of the whiplash, the actual injuries caused, and the possible harm it has had on your emotional state will, all play a pivotal part in the whiplash injury claim.

Special damages for whiplash

Unlike general damages, special damages can be fixed to some degree and are payable to you as a result of you having encountered certain special losses because of the accident. In particular, special damages are payable on any loss of earnings (including any potential loss of future earnings as a result of the accident) you may have to endure while you recover from the accident; car hire expenses you have to pay as a result of your car being in the repair shop; if you have to pay someone to look after you while you recover from your whiplash, these can be recovered; and if you have paid for medical attention to treat the injury, you can also include these in your claim.

If you want to claim for special damages you need to keep a careful track of all the payments you have made and where possible you’ll need to have receipts.

Insurance settlement

If you decide that you do not want to make a whiplash injury compensation claim through the courts, then you need to agree to enter into a settlement agreement with the insurance company. In this case you need to make sure you read the terms of the settlement agreement very carefully as insurance settlement claims usually contain provisions

(1) that the insurance company can pay you in instalments, rather than a one-off lump-sum payment;

(2) that once you have been paid the whiplash compensation by the insurance company you cannot reopen the claim in the future to try and get some more money and agree to no longer hold the insurance company liable for any future cost or loss.

Limitation period to bring a claim

If you have recently suffered a whiplash injury, then you have a period of 3 years from the date of the injury in which to bring proceedings to court. If you fail to bring your whiplash claim to the courts within this time you will have forfeited your right to make a claim.

Whiplash injury solicitor

Whether you have suffered a neck injury, back injury, or bruising, in order to know exactly what your rights are you should seek a consultation with a personal injury solicitor or lawyer as soon as you can following the accident and in any case before you agree to sign any settlement agreement with any insurance company as they are not obligated to tell you what your legal rights are but also what compensation you should be entitled to. Whiplash claims are never easy to deal with but following the advice in this article should lighten the burden.

If you have been, or know anyone who has been involved in a road traffic accident recently and sustained injuries, then this article will provide the very best information needed to secure you compensation for any injuries.

Compensation for Whiplash injuries can range anything from 1000 - 8000 depending on the level of injury and other circumstances involved.

Whiplash injuries usually come to light the following day after an accident. The most common symptoms will include some minor discomfort or pain a few hours after the incident to the neck, shoulders or back regions of the body. By the following day, usually after a nights sleep, this will have developed into more serious pain and discomfort sometimes immobilising the person from moving out of bed.

If you have developed any of the above following an accident then read these top tips for dealing with a Whiplash Injury claim for compensation.

If possible, always take pictures of the accident circumstances such as the damage to other vehicles involved, damage to your vehicle and if evident any signs of the accident on the road surfaces.

Ensure you get all third parties involved in the accident details such as full name and addresses, vehicle plate numbers involved, brief description of the accident, weather conditions and any witness statements. The location, date and time of the circumstances and all parties insurance details if possible. By law everyone involved in a road traffic accident must supply details on request, if anyone involved in the accident does not give any contact details over then we recommend calling the Police immediately for their assistance. If you have Police assistance for the accident always take the PC number and rank for future correspondence.

If you feel pain or discomfort soon after the accident, book yourself a Doctors appointment immediately or at the latest the following day. If the pain becomes steadily worse throughout the day then we recommend you visit your local hospital for full diagnose. Always keep any documentation from your doctor or the hospital on your whiplash injury. Insist on a report of some kind as this will be one of the most important supporting documentation for evidence purposes during your compensation claim.

If you feel any dizziness following the accident, on no account must you drive a vehicle or operate machinery. If you were at work at the time of the accident then report the details immediately to your employer. An accident report should be compiled on the circumstances by your employers health & safety representative which will also act as important supporting evidence in your compensation claim.

Find yourself a reputable Whiplash Injury claim lawyer, solicitor or attorney to work on your behalf for your compensation claim. Most good companies specialising in this area can now be found on the internet easily and will do all the hard work for you. All that will be required from you are copies of the documentation listed above and your authority to legally represent you in this claim.

Never send the original copies as if these were lost then you have no supporting documentation for the accident.

Police Crackdown On Staged Car Insurance Scams

We buy car insurance to help protect our investment: our car. Since many newer cars cost well into the thousands of pounds they are not cheap to replace or repair, insurance helps cover the costs that are associated with owning a car and can help make initial impossible costs bearable for the majority of motorists.

The trouble is that sometimes there are people out there set on abusing the system and for a quick bit of cash they will sacrifice a lifetime of expensive insurance in the future. Some unscrupulous people will often make false claims on their insurance to either make a quick buck or get a better car should their current one be destroyed.

Many of these people believe that the car insurance companies paying out means that it is a victimless crime, we pay our premiums every year, we should make a claim or two to ‘get our money’s worth’. This is completely false as the reason many people, especially younger people, cannot afford the high prices of insurance premiums is the number of false claims as well as drivers who do not have insurance getting into bumps and scrapes.

The police have said that car insurance fraud has become such a big problem that there are even gangs ’staging’ accidents to make their dodgy claims appear legitimate. A recent operation in Greater Manchester has discovered one of these gangs numbering eighteen people who will appear before Stockport Magistrates Court.

There have been other similar cases in the Manchester area such as families driving around with a broken brake light, the car then brakes suddenly at a roundabout where an unsuspecting mark ploughs into the back of the car in front, the family then files for compensation all conveniently suffering from whiplash for a generous payout.

It’s exactly for these reasons that car insurance premiums are so high and continue to rise, with these increased claims then it makes cheap car insurance impossible as the insurance firms are less likely to view average, safe drivers in a fair light. When large scale crime organisations like these insurance fraudsters get caught then it makes roads not only safer for the rest of us but will bring down our car insurance as a bonus hopefully.

How To Avoid Suffering From Whiplash

Recent reports have been suggesting that the UK has become the whiplash capitol of the world with the ABI citing poorly fitted head restraints as the main reason for the 25 percent increase in whiplash claims.

The ramifications of this for everyone else is according to the money saving expert is around a 66 pound increase to everyone’s insurance policy. This has equated to a compensation bill of around 2 billion a year.

The report published by the Association of British Insurers revealed that around 1200 people a day submit a whiplash claim. Simon Douglas the director of AA Insurance, said: "The cost of whiplash claims equates to about 66 for every UK car insurance policy … this is more than twice the cost of claims for accidents with uninsured drivers."It will become an "increasingly important" matter for the cost of policies in the future, he added.

Stephen Haddrill, ABI Director General, said: ‘Whiplash imposes unacceptable costs to individuals, businesses and the state. Insurers want to reduce whiplash, provide fast care and compensation and tackle fraudulent claims. ‘But we cannot do this alone. We call on the Government, road safety groups, the medical and legal professions and other stakeholders to work with us on a campaign to reduce this problem.’

If whiplash claims are costing so much money, what can be done to help stop whiplash injuries thus saving everyone money in the long run? As the ABI study showed the biggest cause of whiplash injuries is poorly fitted head rests. If head rest is fitted so the rest is directly behind the head instead of the neck (where it is usually placed) then it should provide adequate support so the head doesn’t jolt back suddenly when in a crash. The down side to this is that it is not the most comfortable position for your head to be in on long journeys. Basic safety precautions such as wearing a seatbelt is essential, some chiropractors also suggest basic neck exercises will help avoid strain if you where to be involved in a car accident.

Unfortunately most of us don’t have the time or foresight to carry out these measurers so it might be advisable to look into a car that has received a green or gold standard rating in the recent Euro NCAP safety tests. The cars which received this rating in the most recent tests were the, Volvo XC60, Alfa Romeo Mito, VW Golf VI, Audi A4 and Vauxhall/Opel Insignia. Many may not be able to afford a brand new car in this time of recession but it is defiantly worth checking out the Euro NCAP safety ratings for any perspective car as it could save you a lot of neck ach in the future.

So as the UK remains at the top of the whiplash charts it is down to the individual to try and save money and lower the amount of whiplash claims, which are costing every individual around 66 pounds. As we all know everyone is looking to save money and this could be a great way to save the pennies.

Fact: Researchers like Dr. Arthur Croft from the San Diego Spine and Research Clinic and his human crash dummies say you’re less likely to get injured and, he’s the leading authority on whiplash in the US.

Myth #2: The faster the ‘bullet’ vehicle is going, the more severe the whiplash injuries will be in the ‘target’ vehicle.

Fact: You are more likely to get injured from a low speed (less than 10 mph) rear end accident than in a high speed accident. The reason is because the head is delayed more in a low speed accident and the whiplash is actually accentuated.

Myth #3: Men and women are equally susceptible to getting injured in a rear-end collision.

Fact: Women are twice likely to get injured from whiplash then men. Why? Because of muscle mass and neck circumference.

Myth #4: There’s no damage to your vehicle so you couldn’t possibly have been hurt.

Fact: Vehicle collision damage has little to do with human damage, especially whiplash. The acceleration of the occupant when hit from the rear is 2.5 times that of the car.

If you are a victim of a rear-end collision and make a claim for personal injuries with the insurance company for the other driver, beware! Many insurance companies will argue and try and convince you that because the vehicles sustained little or no visible damage, then the vehicle’s occupants could not have been injured. This is not necessarily true. While cars are designed to handle the low speed impact forces, the human body is not.

According to Jeff Mohr of Mohr Manufacturing and the experts at superbumper.com, ‘There are two main reasons why they don’t want to pay…It costs insurance companies, on average 2.7 Billion each year just to fix whiplash injuries and the average cost per claim is $9,900.’

Approximately 75% of all rear impact collisions occur at speeds less than 10 mph and most are direct hits. A quality rear bumper system can help prevent whiplash injuries. They should be designed to compress upon impact and absorb the force of a low impact collision. A lower quality bumper system is less absorbent and allows the brunt of the impact forces to be transferred to the occupants of the car.

Insurance adjusters are very astute at reducing the insurance company’s exposure. Serious injuries can result from what may appear to be a minor impact. Every rear-end collision is different and legal representation may be needed to ensure you are treated fairly.

The ‘Bottom Line’ regarding ‘Whiplash Crash Facts’ (accumulated during 2004 - - and including all the previous years) are as follows:

THERE ARE EIGHT SERIOUS AND ABSOLUTE FACTS IMPACTING AND REGARDING THAT WHICH IS TODAY IDENTIFIED AS A ‘WHIPLASH’ INJURY. THEY ARE AS FOLLOWS:

1#. The ‘Threshold’ for cervical spine soft tissue injury becomes a reality at 5 MPH.

2#. Most injuries occur at speeds below 12 MPH.

#3. Crashed cars can often withstand collision speeds of 10 MPH (some even more) without sustaining damage. (THUS: The concept of ‘No Property Damage - No Cash’ has absolutely been invalidated)!

#4. A delay in the onset of symptoms has been found to be the ‘Norm’ rather than the ‘Exception’.

#5. Mild traumatic brain injury can be the result of a Whiplash -Type injury. (These symptoms are often referred to as, ‘Post Concussion Syndrome’).

#6. Up to 10% of victims of ‘Whiplash’ become totally disabled !

#7. Of the 31 important whiplash studies since 1956 (19 of them executed since 1990) regarding patients from all vectors of motor vehicle accident collision impacts (be they rear, frontal, or side) it was found that ‘over 60% of them’ needed long-term medical follow-up.

#8. In 2003 several million Americans suffered a ‘Whiplash-Type’ injury. This figure flows into the stratosphere each and ever day at an alarming rate of speed!

TIME NEEDED TO RECOVER

Studies have proven that 45% of the victims remained symptomatic at 12 weeks and 25% remained symptomatic at 6 months. The most minor cases needed at least 8 weeks to recover. The time needed to stabilize in the more severe cases took 17 weeks. THUS: The written (and often declared) notion that ‘Whiplash Injuries Heal In 6 To 8 Weeks’ is just not true !

CHILDREN AND THE ‘WHIPLASH-TYPE’ INJURY: Youngsters who have had Whiplash-Type injuries display sleep disturbances and nightmares, difficulties in talking to parents and friends, mood disturbances, poor academic performance and specific fears when it came to impact related play. ANOTHER SERIOUS CONCLUSION: Children who have been involved in motor vehicle accidents are often neglected as having had ‘Any various types of injury’, when in actuality, they suffer from the same symptoms as adults. As a matter of fact, they’re at a greater risk for damages - - especially when it comes to ‘WHIPLASH’ !

THE FIVE MOST COMMON MYTHS AS APPLIED TO ‘WHIPLASH’

#1. Low speed impact crashes don’t cause injuries.

#2. Injuries heal in 6 to 12 weeks.

#3. A patients pre-injury psychological makeup affects recovery.

#4. The greater the vehicle damage the greater the occupant injury.

#5. An ‘Accident Re-Constructionist’ can predict injury potential.

All five of these ‘Conclusions’ have been proved to be totally incorrect !

THREE SOLID ‘INJURY-CRASH-FACTS’

#1. Most injuries occur at speeds below 12 MPH.

#2. Rear-end impacts of 6 MPH to 12 MPH cause the most injuries.

#3. Between 1 and 2 years post-injury, 22% of patient’s conditions have not returned to ‘Normal’.

NINE ABSOLUTELY CORRECT WHIPLASH ‘RISK-FACTORS’

#1. DEGENERATIVE DISEASE: Headaches and/or neck injury pain (for whatever reasons) prior to the crash.

#2. PRE-EXISTING HEALTH PROBLEMS: These can positively lead to even greater pain. (For example: A solid Arthritis situation will always lead to the severity of the injury and the pain).

#3. VEHICLE SIZE: Even if both are about the same size an 8 MPH impact produces two times the force of gravity. If one is greater than the size of another the Gravity-Force becomes monumental!

#4. HEADREST POSITION: The injury becomes much worse if it’s too far away. It must be close enough to catch the head in time - - or about 2 inches. (Over 98% of the headrests are more than 2 inches from the head).

#5. POSITION OF HEAD AT IMPACT: If not positively straight (it rarely is) all the G Forces are localized to one side of the spine, substantially increasing the severity of injuries.

#6. AGE: How old one is plays a crucial role regarding a ‘Whiplash-Type’ of injury. Why? Because as the body becomes older, ligaments become less pliable, muscles are weaker and less flexible plus there’s a decreased range of motion.

#7. WOMEN AND CHILDREN: They injure more seriously than men because they have smaller necks. They may also be too close to the steering wheel, airbag and/or are wearing an improper fitting shoulder harness.

#8. NON-USE OF: The motor vehicle’s shoulder harness.

#9. FAILURE TO WEAR A SEATBELT!

ALWAYS REMEMBER YOUR MEDICAL PAYMENTS COVERAGE

YOU MUST READ AND UNDERSTAND ALL THERE IS TO KNOW ABOUT YOUR MOTOR VEHICLE INSURANCE ‘MEDICAL PAYMENTS’ COVERAGE: This coverage pays all Medical (and often even funeral expenses) for you, your spouse and even relatives living in your home, and/or others who are injured while operating your motor vehicle.

HERE’S A ‘BIGGIE’ THAT MANY PEOPLE ARE NOT AWARE OF: You and your resident family members may also be covered as pedestrians regarding the payment of your medical bills - - should you have been struck and injured by a motor vehicle.

PLUS: WHEN IT COMES TO YOUR MOTOR VEHICLES ‘MEDICAL PAYMENTS’ COVERAGE - - HERE ARE TWO HUGE FACTS YOU MUST INVESTIGATE:

#1. You’re usually paid (regardless of who was at fault for the accident) up to the limit of the coverage you’ve selected.

#2. The coverage often extends to expenses incurred - - within he first three years of the accident !

Whiplash Compensation Claim - Take These Actions

Even the most cynical of us would agree that occasionally accidents do happen.

However, more often than not, an ‘accident’ isn’t really an ‘accident’ at all and a certain level of fault for the accident has to be placed squarely on the shoulder of the person who caused the accident. The same is certainly true in the case of a car accident. So, how would you go about getting proper whiplash compensation following a car accident?

Unlike other injuries that can occur in a car accident, more often than not the symptoms of whiplash, such as a whiplash neck injury, will not manifest themselves until the morning after. Usually, the accident will cause the whiplash to manifest in the form of:

a headache, most likely all over the head with particular emphasis on the back of the head, or the forehead, or behind the eyes of the victim; or

neck pain; or

both of the above, with the headache likely to be more painful initially than the neck ache, but with the neck ache likely to be more prolonged and with the chance of this developing into Osteoarthritis in the future.

So, with an accident injury of this nature, i.e. one that does not manifest itself immediately, you would think that making a whiplash injury compensation claim would be an extremely onerous task - as causation proof of the injury would be difficult. However, you can make it easier to make a compensation claim for whiplash if you adhere to the following guideline procedures following the accident:

1. As Soon As You Can, Write Down Exactly What Happened That Caused The Accident To Happen

When you write your notes about what happened to cause the accident, which you should try and do as soon as you can following the accident. You need to make notes of exactly what happened leading up to the accident, during the accident and subsequent to the accident. You should also take note of:

where the accident took place
what the weather conditions were like (e.g. was it foggy and slippery?)
what the time was
whether there were any witnesses who can verify your story
exactly what you said to the other person(s) involved

If possible you should use your mobile phone camera to take photographs of the damage done to your car and you, as well as of the road surface and the general weather conditions.

2. Have A Medical Examination Immediately

Even if you are not feeling too bad following your accident, it can take a few hours, even a sleep, for the symptoms of whiplash to manifest. However, the longer you leave it until you get a medical examination the more chance there will be that the person who caused the accident can say that your injuries could have been caused by something else other than the car accident. Or, worse, the whiplash injuries could have been mitigated if only you had sought medical attention earlier.

To protect both yourself and your potential whiplash injury compensation claim, you should take yourself off to the hospital and have a complete medical examination as soon as you can, following the accident. Once you have had the examination you should ask the doctor to write a report detailing the chances of you having suffered an injury as a result of the accident - including the chances of you having suffered whiplash.

If you do this, you may well find that it is a lot harder for the person who caused your injury to claim that the whiplash was the cause of anything but their actions.

Keep in mind that whiplash injuries can have lasting effects. They can also have a very dramatic effect on your life - especially if they manifest into Osteoarthritis. So do not take a potential whiplash injury lightly and make sure that you protect any future rights that you may have to bring a whiplash injury claim.

Having the right accident solicitor makes all the difference in the world when you make a whiplash injury claim. Choosing the wrong one means you’re back behind the wheel, at the accident.

It happens all the time: long, tiresome travel, a moment of distraction or a sudden meeting with a road-hog - and suddenly you end up in a crash. Whiplash injury is very often, maybe 80% of the time, the result of car accidents.

It’s an injury caused when the neck suddenly jerks backwards and forward or vice versa during a collision. A small percentage of whiplash injuries can cause traumas lasting many several years with many chronic problems. Each year British insurers deal with approximately 250,000 claims for this kind of injury! That’s a quarter of a million claims.

Recognise The Symptoms!

There are no two identical accidents and the symptoms of a whiplash injury may vary depending on e.g. vehicles’ speed, kind of collision (whether it’s front, rear or side), etc. Saying all that, there are some symptoms, which may often vary on a day-to-day basis. Victims can suffer from headaches, dizziness and nausea together with vomiting. Shoulders and arms become stiff or numb or one can feel neck and back pains or ‘pins and needles’ type of feeling. Blurred vision and ringing in the ears may also occur.

The Whiplash Injury Claim

As you will see, whiplash injury may result in long months of health problems and discomfort. Wearing a collar support, living on pain and anti-inflammatory medications - is not an easy time for anyone. Not mentioning how it can affect your daily job making it difficult or even impossible to perform the simplest task. Don’t you think that you deserve some solid compensation for all your health problems and frustration?

You deserve to make a whiplash injury claim in the fastest, easiest and least stressful way possible. It’s hard to deal with insurance companies when you’re injured and simply tired with the present situation.

So How Would You Handle It?

The answer is very simple: make use of a good accident compensation solicitor. They not only become your legal advisor - their job is to take care of all the process of claiming your accident compensation.

First, they grant you professional medical examination of your injury. Then handle all the procedures - pays the bills and fees, represent you in court, etc. You don’t have to worry about anything - it’s the solicitor’s duty to make your claim successful and to win the compensation for you in the most comfortable manner.

Companies hassling injured people and offering their services in brazen and insolent ways belong in the past. Nowadays, the methods of an injury claim is customised to make the process of claiming compensation stress-free. In cases of painful and lingering health problems, like whiplash traumas, making it as easy as possible, is just priceless.

Priceless? But Really, What Is The Price Of It?

Probably the most important aspect for you is, the services of an accident solicitor doesn’t cost you anything at all. If you successfully claim your injury compensation, you get 100% of it - no tricks.

All the bills and payments are paid by the party who lose the case. On the other hand, if you lose, you don’t pay for anything either - the solicitor makes all the payments.

Why should you pay for something that wasn’t your fault? It’s logical, isn’t it? So there is no risk involved in cooperating with an accident solicitor.

Whiplash injury itself is painful enough. Why would you add the pain of handling all the compensation claim by yourself, if you can make use of a quality solicitor?

It’s easy, stress-free and free - don’t forget about the last one. Solicitors are not a leech wishing to suck your wallet dry - you don’t pay a single penny for their help as it gets recovered from the other party insurers. But instead, as a ‘friend’ in need, makes your life easier when the troubles comes upon you.

A whiplash injury claim is probably the most common action for compensation that solicitors have to deal with and accounts for thousands of claims across the UK every week. This injury is caused by a sudden acceleration or deceleration of the head and neck often as a result of a rear end shunt in a vehicle accident and is also known as acceleration/deceleration syndrome.

In its mild form it is referred to as a neck sprain and is characterised by a collection of symptoms that occur following damage to the neck usually as a result of a sudden change in motion affecting the discs, muscles, nerves or tendons of the neck. The damage is caused when head is violently thrown back, forwards or sideways followed by reflex contraction in the opposite direction. Swelling and inflammation occur following damage caused by rapid movements, which leads to pressure being placed on the nerves resulting in subsequent pain and discomfort.

To pursue a whiplash injury claim it is very important to make urgent arrangements after an accident to be medically examined either by your general practitioner or at the local hospital Accident and Emergency (A&E) department. The GP or hospital record will be used by your solicitor in due course to prove the extent of the immediate post accident medical condition and without this medical evidence it is extremely difficult to sustain a claim for damages.

Severe whiplash can cause serious damage to the spine and nervous system and this may often be resolved only over a long period of convalescence. In a minority of cases a chronic conditions may develop, which results in constant pain and disability, with little hope of resolution of the discomfort. Damage to the bones in the neck rarely occurs however on those occasions when it becomes a problem it may be necessary to surgically repair the bone or cartilage occasionally involving fusion of the vertebrae.

Symptoms of injury include dizziness, blurred vision, headache, nausea or vomiting, balance problems, pain or stiffness and loss of feeling or prickling in an arm or hand. It may also cause memory loss, concentration impairment, nervousness, irritability, sleep disturbances, fatigue and depression

If you are involved in a motor accident that is not your fault and you suffer personal injury you may be entitled to compensation. The amount of awards will vary dependent on the severity of the illness and the overall recovery period and whether or not there are any long term symptoms or disabilities. Damages vary from 2,000 for mild neck strain up to 250,000 for serious long term injury requiring surgery. Further compensation is also payable for financial losses caused as a result of the accident including loss of past and future wages, loss of advantage on the open labour market, a detrimental change in lifestyle as a result if the injury, damage to personal property and all reasonable general expenses and losses sustained as a direct result of the accident.

If you have had an accident and believe that you may be suffering from any personal injury you should seek proper medical advice as soon as possible. Diagnosis is normally swift, as this is a common injury associated with road traffic accidents. Diagnosis depends on various factors including the medical history, observation of symptoms and a physical and neurological examination. X-rays are done to remove any possibility of a fracture. A CAT Scan, MRI and other imaging tests may be required depending on the severity of the patient’s symptoms.

Treatment is usually by way of pain medication, anti-inflammatory drugs, muscle relaxants and physical therapy. Severe injury may be treated with a surgical collar, cervical traction and heat therapy. Surgery is not common. Sometimes though there can be a tear in an inter-vertebral disc which may have to be removed followed by fusion of the neck vertebrae.

Legal Claim UK is a national network of personal injury solicitors.
